Terms of Service

1. The service

StudioVita is a SaaS gym and fitness studio management platform. It enables studios to manage members, class schedules, bookings, payments, and communications, and provides members with a branded mobile-first app.

2. Free trial

All plans include a 30-day free trial with full access to platform features. No credit card is required to start a trial. If no plan is selected before the trial ends, access will be restricted until a plan is chosen. You will not be charged automatically at the end of your trial.

3. Subscriptions and billing

• Subscriptions are available on monthly or annual billing cycles
• Plans available: Starter, Growth, Professional, and Enterprise
• Payments are processed securely by Stripe. StudioVita does not store payment card details
• You may cancel your subscription at any time with no cancellation fees. Access continues until the end of the current billing period
• Prices may change with 30 days' written notice to existing customers. New pricing applies from the next renewal after the notice period

4. Refund policy

• Monthly subscriptions: Non-refundable. You may cancel to prevent future charges
• Annual subscriptions: Eligible for a pro-rata refund within the first 30 days of the annual term. After 30 days, annual subscriptions are non-refundable

5. Acceptable use

You agree not to:

• Use StudioVita for any unlawful purpose
• Abuse, harass, or attempt to harm other users of the platform
• Attempt to exceed your plan's member limits through technical workarounds
• Attempt to reverse-engineer, copy, or replicate the StudioVita platform
• Upload or distribute malicious code, spam, or inappropriate content

We reserve the right to suspend or terminate accounts that violate these terms.

6. Data ownership

Studios and their members own their data. StudioVita acts solely as a data processor providing the technology platform. We do not sell, share, or exploit studio or member data for any purpose beyond operating the service.

7. Intellectual property

StudioVita, including its code, design, branding, and content, is owned by Freddie Media Ltd and protected by copyright and other intellectual property laws. You may not copy, reproduce, or create derivative works from StudioVita without our written permission.

8. Limitation of liability

StudioVita is provided on an "as-is" basis. We make reasonable efforts to maintain uptime and reliability but do not guarantee uninterrupted service. To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the fees paid by you in the 12 months prior to the claim

9. Termination

• Either party may terminate the subscription with 30 days' notice
• We may terminate immediately for material breach of these terms
• Upon termination, your studio data remains available for export for 30 days, after which it will be permanently deleted

10. Governing law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
